SC refuse to consider PIL seeking guidelines to regulate Cryptocurrency

On Friday, the Supreme Court decided not to consider a public interest litigation (PIL) petition that was requesting the establishment of guidelines for the regulation of cryptocurrency.

The Chief Justice of India DY Chandrachud, along with Justices JB Pardiwala and Manoj Mishra, observed that the PIL, although filed under Article 32 of the Constitution, seemed to be primarily aimed at securing bail for the petitioner in a connected case.

"We cannot entertain this matter. The other requests fall within the jurisdiction of the legislative branch. The petitioner may seek recourse from other legal authorities for remedies," stated the Chief Justice of India (CJI).

The counsel representing the petitioner argued that since cryptocurrency was acquired voluntarily, there should be no offense under the Indian Penal Code related to such transactions.

Nonetheless, the Court declined to proceed with the case, stating that the petitioner should seek resolution through other available avenues. The Court also questioned, "Why should the Supreme Court be involved in this matter?"

The petitioner, Manu Prashant Wig, is presently in judicial custody as a result of a case filed by the Economic Offence Wing of the Delhi Police in 2020. Wig holds a position as one of the directors of Blue Fox Motion Picture Limited.

Nevertheless, the situation took a turn when 133 investors/victims subsequently filed complaints with the Economic Offence Wing (EOW), alleging that they had been deceived and that their funds were not returned.
