SC Rebukes UP Government for Failing to Appoint Counseling Agency for Muslim Student

The Supreme Court on Friday (November 10) rapped the state government for not complying with orders to appoint an agency for counseling of a Muslim student and his classmates at a school in Uttar Pradesh's Muzaffarnagar district.

Allegedly, the female teacher of the school had instructed the students to slap if their homework was not completed. The female teacher of the school has also been accused of making communal remarks about the victim boy.

Noting that the court order was not complied with, a bench of Justices Abhay S Oka and Pankaj Mithal directed the Principal Secretary of the State School Education Department to remain present virtually during the next hearing to avoid any coercive action. Have given instructions.The Supreme Court had appointed Mumbai's Tata Institute of Social Sciences (TISS) to suggest the mode and method of counseling the child involved in the incident and his classmates.

During the hearing today, the bench said that after hearing the counsel for the parties, we believe that the Uttar Pradesh government and especially the education department have not followed various orders given by this court from time to time. Proper counseling was not done to the victim child and other children involved in the incident. The affidavit filed regarding counseling children shows that the approach of the state government is shocking.

Therefore, we appointed Tata Institute of Social Sciences, Mumbai to suggest the mode and method of providing counseling to the child and other children, the bench ordered. TISS will also suggest the names of expert child counselors available in the state. The bench said that the counseling can proceed under the supervision of TISS.

The Supreme Court directed the UP government to provide all infrastructural assistance and support to TISS and ordered it to submit a report before the next date of hearing, December 11.

The bench said, "We direct the Principal Secretary of the Education Department to remain personally present to avoid any coercive action of the court." The bench said, "We hope that he will appear personally in this matter." Will look into the matter and see that the instructions are followed.

Muzaffarnagar police had registered a case against the female teacher for allegedly making communal remarks against the Muslim boy and getting him beaten by his classmates. A notice was also given to the school by the State Education Department.

In a video, a teacher was allegedly seen asking students to slap a Class 2 boy in Khubbapur village. The teacher had allegedly made communal remarks, after which a case was registered against her. The video was said to be of 24th August.

On November 6, the Supreme Court had asked the Uttar Pradesh government to provide the boy admission facility in a private school. The top court is hearing a petition filed by Tushar Gandhi, great-grandson of Mahatma Gandhi, in which a speedy investigation has been demanded in the case. On October 30, the Supreme Court had directed the Uttar Pradesh government to take an immediate decision on granting sanction to prosecute the school teacher.
