The Supreme Court has ordered a CID investigation into allegations of influence peddling against the husband of a Calcutta High Court judge in a land dispute case.
While giving this order, the division bench of Justice Sanjeev Khanna and Justice LVN Bhatti has asked the CID to submit the investigation report in a sealed cover by December.
A 74-year-old woman has accused her relatives of trying to throw her out of the house for illegally occupying her land. Two FIRs were lodged in the police station regarding this, on the basis of which an arrest was made.
The judge's husband is the defense counsel in the case, who is accused of influencing the police investigation. The old woman says that it is because of her influence that the investigation of the case is not progressing even after the arrest. He had filed a petition regarding this in the Supreme Court, hearing which the division bench has given this decision. CID has been asked to investigate the case completely without fear.
Two FIRs were filed in the case under relevant sections of the IPC, one on September 7 and one on September 8, this year.
During the hearing, the counsel representing the West Bengal government submitted a report to the Chief Justice of the Calcutta High Court on September 15, providing an update on the investigation's status.
The counsel further submitted that the Bengal government is proceeding with the investigation.
"The government has transferred the investigation to CID for fair investigation. Further, the state is proceeding cautiously considering the involvement of certain persons, who are interfering in an investigation into the matter," the counsel said.
The matter is now posted for December this year.
