Today, the Supreme Court of India issues notice to Central Bureau of Investigation's (CBI) petition, challenging temporary bail awarded to former ICICI bank chief Chanda Kochhar by the Bombay High Court in the Videocon loan case.
A bench of Justices Aniruddha Bose and Bela M Trivedi stated that the matter will be taken up next after three weeks.
Earlier, in January Bombay High Court directed the temporary release from judicial custody of Chanda Kochhar, the former Managing Director and Chief Executive Officer (CEO) of ICICI Bank, and her husband Deepak Kochhar, subsequent to their arrest by the CBI.
The Court in judgement held that, the arrest was in violation of Section 41A of the Code of Criminal Procedure (CrPC), which mandates sending of a notice for appearance before the concerned police officer prior to carrying out an arrest in certain cases.
The High Court additionally observed that the arrests were executed four years following the registration of the criminal complaint.
The High Court later extended the provisional bail, prompting the CBI's current appeal before the Supreme Court.
Case Brief -
Chanda Kochhar, along with her husband Deepak Kochhar, was arrested by the CBI on December 24 on charges related to fraud and irregularities in the approval of loans amounting to ₹3,250 crores in 2012 for the Videocon Group.
The complainant had asserted that Chanda Kochhar's husband and her family members had gained advantages from these transactions.
Later, the special CBI court had remanded them to judicial custody on December 29.
