Today, the Supreme Court of India has imposed ₹10k costs on BJP leader Aminul Haque Laskar for seeking adjournment in his case against All India United Democratic (AIUDF) leader Karim Uddin Barbhuiya.
A bench consisting of Justices Aniruddha Bose and Bela M Trivedi expressed disapproval of the adjournment request, which was made due to the unavailability of the petitioner's senior counsel, Jaideep Gupta.
It, therefore, proceeded to impose costs on Laskar.
The amount was directed to be deposited with the Supreme Court Advocates' Welfare Fund.
Case Brief -
The case originated from the 2021 election in which Barbhuiya was elected from the Sonai Legislative Assembly constituency, defeating Laskar. Subsequently, Laskar, armed with information acquired through the Right to Information Act (RTI Act), lodged an election petition challenging Barbhuiya's victory.
The petition alleged discrepancies in the educational qualifications listed in the election affidavit of the AIUDF leader. According to the petition, Barbhuiya had claimed in his affidavit submitted to the Election Commission before the previous Assam assembly elections that he had graduated from Choudhury Charan Singh University in Meerut in 2019. However, the State education board had no record of him passing the class 12 examination.
Despite this, the Commission allowed him to participate in the elections, prompting Laskar to file an election petition with the High Court. On April 26, the Gauhati High Court rejected Barbhuiya's application to dismiss the election petition, leading to the current appeal before the Supreme Court.
The Supreme Court took notice of the case in May and temporarily halted proceedings against Barbhuiya.
