The Supreme Court on Monday imposed an interim stay on the defamation case going on in Ahmedabad against Bihar Deputy Chief Minister Tejashwi Yadav.
The court gave this order while issuing notice on Yadav's transfer petition. Tejashwi Yadav had filed a petition in the Supreme Court demanding transfer of this case outside Gujarat. In March this year, Tejashwi Yadav had called Gujaratis as thugs, on which a case was registered against him.
At the same time, on November 4, Tejashwi Yadav had informed the lower court of Ahmedabad that he was going to the Supreme Court requesting transfer of the criminal defamation case filed against him. The Deputy Chief Minister of Bihar, through his lawyer, had also requested for exemption from appearance in the court of Additional Metropolitan Magistrate DJ Parmar. In this case he had to go to Gujarat again and again. For this reason he had demanded transfer of the case.
Tejashwi Yadav had said, 'Only Gujaratis can be thugs.' When a criminal defamation case was registered on this, a hearing on this was also held in the lower court in September. The court also summoned him in the hearing held on 22 September. After this, a hearing was held in the court on Saturday also, but due to Tejashwi's absence it was postponed. The lower court has fixed the next date of hearing in this case as December 2. But the complainant said that the case should be heard even in Tejashwi's absence.
At the same time, the lawyer appearing in the court on behalf of Tejashwi told through a petition that the Deputy CM of Bihar has not been able to appear due to being busy in an official program. The court was told that a petition has been filed in the Supreme Court under Section 406 of CrPC requesting to transfer the case. This matter is to be heard on November 6. Tejashwi said in the petition that he could not appear in the court due to important and official commitments.
