On December 2, the Supreme Court declined to hear a petition requesting that the Bar Council of India waive enrolment fees for transgender people. A bench consisting of CJI DY Chandrachud and Justice PS Narasimha heard the case.
"You can't say that don't charge enrolment fee! Then why just transgender persons? Why not extend this to women, disabled and marginalised persons? You must understand the parameters of judicial review."
If fee waivers for bar council enrolment are permitted, such fee waivers must be extended to other fields, such as medicine, according to CJI Chandrachud. He also stated that the parameters of judicial review did not allow the court to issue such orders. As a result, the bench determined that the petition lacked merit and advised the petitioner to withdraw the petition and file appropriate representation with the Bar Council of India.
Initially, the petitioner claimed that transgender people belonged to the country's most marginalised community and needed assistance in the form of fee waivers. As a result, the petition was deemed withdrawn and rejected.
