On December 6, the Supreme Court's division bench observed that the Bar Council of India, as a major body, must come up with proposals to deal with situations involving advocates agitating and going on strike. The bench, which included Justices Dinesh Maheshwari and Sudhanshu Dhulia, stated that the Bar Council of India must play a significant role in finding a solution. The Bar Council of India, represented by Advocate Ardhendumauli Kumar Prasad, informed the Court that it had taken action and suspended the lawyers in Odisha who were boycotting courts.
Further the court also stated: "This is a matter which should concern all of us not only on the point of law but otherwise as well and all of us have to apply ourselves in the matter." The bench observed that, "Suspending won't do.....Bar Council of India is only taking short measures....Some major steps are required to be taken."
The court gave the parties three weeks to file short notes in the matter and scheduled a further hearing on January 24, 2023.
The Supreme Court recently stated that it expected the Bar Council of India to suspend the licences of the lawyers who have been on strike in Odisha over a long-standing demand for a permanent bench of the Orissa High Court in the state's western part, at Sambalpur. The Bench, which included Justices Sanjay Kishan Kaul and Abhay S. Oka, also advised the Bar Council to take "appropriate action" against the district bar associations whose members were associated in the protests.
