Salary shall not be stopped only on the ground that they have not opted for registration under PRAN: Allahabad HC

On January 3, a single-judge bench of the Allahabad High Court led by Justice Pankaj Bhatia directed the state government not to stop paying its employees' salaries solely because they have not opted for the National Pension System. The Court requested a response from them within six weeks.

“Until further orders, salary to the petitioners shall not be stopped only on the ground that they have not opted for registration under PRAN in terms of Clause 3(V) of the Government Order dated 16.12.2022,” the Court ordered as it parted with the order.

Certain state employees (Yogendra Kumar Sagar and others) filed a writ petition challenging the state government's notification of mandatory participation in the National Pension System.

The petitioners, who have not opted for the National Pension System, moved the Court, claiming that the UP Govt issued an order on December 16, 2022, stating that employees who do not opt for the National Pension System and do not register with PRAN will not be entitled to a salary under Clause 3(V).
