The Supreme Court's division bench will hear a review petition against the order acquitting the three men accused in the 2012 Chhawla Gang Rape on Thursday. The bench of CJI DY Chandrachud, Justice JB Pardiwala, and Justice PS Narasimha heard the mentioning. The counsel requested an expedited hearing because the public's trust had been shaken by the case's conversion from capital punishment to acquittal. The judgement under review was passed by a bench consisting of former Chief Justice U. U. Lalit and Justices Ravindra Bhat and Bela M. Trivedi. It had overturned the Delhi High Court's decision, which had convicted the three men of rape and murder of a 19-year-old girl.
Rahul, Ravi, and Vinod were accused of kidnapping the girl while she was returning home from work on February 9, 2012. On February 14th, police discovered the girl's mutilated body near Rewari in Haryana, with multiple wounds. During the autopsy, it was discovered that she had been attacked, raped, and acid had been poured into her eyes. The Supreme Court issued its decision after hearing arguments from Additional Solicitor General Aishwarya Bhati, who sought to uphold the death penalty, and amicus curia Senior Advocate Sonia Mathur, who pursued to overturn it.
The trial court had previously sentenced the three accused to death, which the High Court upheld in its August 2014 decision.
