In a recent legal development, the Delhi High Court has rejected a bail application from a tuition teacher facing allegations of sexual assault against a minor student. The accused has asserted that the relationship was consensual.
Justice Swarana Kanta Sharma emphasized that the consent of the victim, who was just 14 years old at the time, does not constitute legal consent. This ruling was based on the recognition that the accused held a dominant position as the victim's teacher.
In a recent court order denying the accused's bail application, the Court dismissed the argument put forth by the applicant's counsel that the relationship between the parties was consensual. The Court emphasized that this argument had no merit, as at the time of the initial sexual assault in 2012, the victim was only 14 years old, and her consent was legally considered no consent.
It was alleged by the victim in the complaint that in the year 2012 when she was just 9 years old when she was attending classes in a coaching centre where the accused was a teacher and started to sexually assault her. She further stated that the accused kept on making physical relations with her on the pretext of getting married one day.
The victim also alleged that she got pregnant twice in this while and got abortions done. Alongside it was also revealed that the accused was already married.
On the basis of the allegations a complaint was registered under the Indian Penal Code and the Protection of Children from Sexual Offences Act.
