Recently, actor Rakhi Sawant has taken her case to the Bombay High Court, requesting the dismissal of charges involving defamation and outraging of modesty, which were filed against her by another model. In her petition, Sawant asserted that the complainant filed a false First Information Report (FIR) out of a motive for revenge against her.
"The baseless allegations and defamatory remarks made by the complainant have not only caused personal anguish but have also inflicted significant damage to Sawant's previously thriving career," stated Sawant in the petition filed through her advocate, Ali Kaashif Khan.
The model lodged a complaint alleging that on October 31, 2022, Sawant displayed certain videos of the complainant and accompanied them with defamatory remarks. Additionally, the complainant asserted that the video showcased to the media contained sexually explicit content.
Sawant faced charges under Sections 354(A) (outraging the modesty of a woman), 500 (defamation), 504 (criminal intimidation), 509 (intent to provoke a breach), and 34 (common intention) of the Indian Penal Code (IPC), in addition to Section 67(A) of the Information Technology Act (IT Act).
Sawant asserted that a thorough review of the FIR, without delving into the specifics, would reveal the lack of authenticity in the allegations. She further emphasized that both parties had mutually settled their differences. Yet, the lingering FIR seemed to be a deliberate tactic employed by the complainant to needlessly consume the court's time.
In her petition, Sawant contended that the offence of outraging modesty under Section 354A of the IPC was not applicable to women, as it specifically pertained to men. As a result, she requested the quashing of the FIR and the chargesheet filed on October 18.
