On Saturday, a Public Interest Litigation (PIL) was submitted to the Rajasthan High Court disputing the appointment of Diya Kumari and Prem Chand Bairwa as deputy Chief Ministers.
The petition contends that the Constitution does not acknowledge this position, questioning the validity of their swearing-in.
Om Prakash Solanki, the petitioner and a lawyer, additionally requested the annulment of the appointments in question.
"Deputy Chief Minister post is unconstitutional, and there is no such post mentioned in the Constitution of India," he said.
During a ceremony attended by PM Narendra Modi and the party's top leadership, BJP leader Bhajan Lal Sharma assumed office as the chief minister on Friday.
Simultaneously, Diya Kumari and Bairwa were inaugurated as deputy Chief Ministers.
