Punjab and Haryana HC established dedicated toilet facilities for transgenders

The Punjab and Haryana High Court has implemented a system of separate toilets for transgenders in Court campus. This initiative was spurred by a letter from Chandigarh-based advocate Maninderjit Singh to the High Court administration in 2021, advocating for this change.

Last year, Singh took his efforts further by writing to Chief Justice of India (CJI) DY Chandrachud, urging the implementation of separate toilets for transgender people in all judicial buildings and constitutional courts across the nation.

Responding to Singh's request, the High Court forwarded the matter to the Chief Architect of Chandigarh for review. They were instructed to evaluate the feasibility of such a provision in light of the 2014 Supreme Court judgment in the case of National Legal Services Authority Vs. Union of India and the 2019 Transgender Persons (Protection of Rights) Act.

"figure out the feasibility for providing toilet for Transgender in the premises of this Court by making a joint exercise/inspection and thereafter, they shall submit the feasibility report to this Committee, immediately," the letter by Registrar to Chief Architect stated.

Subsequently, a collective of five toilets were designated for use by transgender persons at various location in High Court premises.

Earlier, in April 2023, CJI had approved gender-neutral washroom in the Supreme Court.

The CJI had ordered construction of nine universal, gender-neutral restrooms at different locations in the main building as well as the additional building complex of the Supreme Court.

The initiative was prompted by a letter from Rohin Bhatt, a queer and non-binary lawyer, to Justice Hima Kohli, who chairs the Supreme Court Gender Sensitisation and Internal Complaints Committee. In the letter, Bhatt urged for inclusive infrastructure within the Supreme Court.

In a similar vein, the Madras High Court issued a directive in February, calling upon the Tamil Nadu government to respond to a plea advocating for gender-neutral public restrooms throughout the state, specifically for transgender individuals.

Likewise, the Gujarat High Court recently took action by issuing notices to both the Central and State governments regarding a public interest litigation (PIL) petition. This petition sought the implementation of separate restroom facilities for transgender individuals in Gujarat.
