PIL seeking state compliance with court orders rejected by SC

The Supreme Court of India has taken a firm stance on the issue of compliance with judicial orders. A Public Interest Litigation (PIL) was brought before the court, urging the Centre, states, and union territories to adhere strictly to judicial directives. However, the bench, headed by Chief Justice DY Chandrachud, swiftly dismissed the PIL, highlighting the fundamental principle that all court orders must be complied with, subject to certain conditions.

The bench, which also included Justices JB Pardiwala and Manoj Misra, emphasized the duty incumbent upon all parties governed by court orders to adhere to them. The dismissal of the PIL underscores the inherent obligation of compliance within the judicial system, barring any exceptional circumstances or pending appeals.

The bench expressed incredulity at the notion of issuing a common order through the entertainment of a writ petition, questioning the rationale behind such a request. Additionally, the petitioner, lawyer KK Ramesh from Madurai, Tamil Nadu, was advised by the bench to seek tutelage under a senior lawyer to enhance their understanding of legal principles.

Chief Justice Chandrachud reiterated the essence of legal practice, emphasizing that directives for compliance are typically issued in scenarios where there is a lack of adherence to court orders. He emphasized that the law mandates compliance with court orders once they are passed, without the need for additional directives.

Case: KK Ramesh vs Union of India.
