P&H HC seeks Explanation from Haryana Government on Senior Citizen Property Disputes Under Maintenance Rules

The Punjab and Haryana High Court has asked the Haryana government to explain why there is no order of vacating the property or house while deciding the petition of a senior citizen under the Haryana Maintenance of Parents and Senior Citizens Rules by the District Magistrate in the state are passed.

High Court Justice Vikas Bahl has passed this order while hearing a petition filed by a senior citizen of Gurugram.

The petitioner had filed an application under the Maintenance of Parents and Senior Citizens Rules before the District Magistrate, Gurugram, praying for protection of her life and property and a direction to her son to vacate the first floor of the house owned by her. 

The Court was informed by the petitioner that instead of passing orders on the said application, the Authority had shown a document to the petitioner stating that the Authority could not take any further action thereon and referred to the letter issued by the Director in this regard. Has been given.

General, Social Justice, Empowerment, SC & BC Welfare and Antyodaya (Services) Department, Haryana referred to the judgment passed by a bench of the High Court to all the District Magistrates. Counsel for the petitioner argued that it is up to the authority to pass the order and The matter cannot be kept in abeyance merely on the basis of a few letters. Hearing this, the High Court has adjourned the case for November 29, seeking clarification from the Haryana government.
