No one can be kept in jail forever, Supreme Court said in Sisodia case

Recently, During the hearing on the bail plea of Manish Sisodia, accused in the Excise Policy case, a bench led by Justice Sanjeev Khanna said that a person cannot be kept behind the bars indefinitely just because the hearing of trial court has not started.

''Once the charge sheet is filed, then you cannot keep someone in jail like this. One cannot be kept behind bars in jail indefinitely because you do not know when the charges will be argued.'' , the Court said.

However, the Supreme Court asked Additional Solicitor General Raju, appearing for ED and CBI, whether the crimes and charges would be different in the case of CBI and ED? Also said that this is a case of tampering with evidence. This is a broad issue and is prima facie a basis for denying bail.

The bail application of Delhi Deputy CM Manish Sisodia, accused in the excise policy case, was heard in the Supreme Court. During this, the Additional Solicitor General appearing on behalf of ED and CBI said that they are considering making Aam Aadmi Party also an accused in this case.

Additional Solicitor General SV Raju told the bench of Justice Sanjeev Khanna and Justice SVN Bhati that he has received instructions in this case that the agency is considering making Aam Aadmi Party also an accused in this case.

During this time, the Supreme Court has asked Raju to clarify whether he wants to file a separate charge sheet in this case?

Raju said that in the investigation that has been done, the investigating agency has found that the Aam Aadmi Party has also been a beneficiary in this case. It is alleged that the money was used in the Goa Assembly elections.

Justice Sanjeev Khanna asked the Additional Solicitor General to explain whether the crime is different or is it the same crime in the ED case? You answer this question on Tuesday.

Will there be separate charge in corruption case? Will there be a separate charge in CBI case? On this, the Additional Solicitor General said that the charge may be different, but the crime is the same. The bench said that you should clarify this. During this, Abhishek Manu Singhvi, appearing on behalf of Sisodia, said that now the bail hearing is going on. 5 supplementary charge sheets have been filed in the case.

There are 500 witnesses and 50 thousand documents have been presented. Now it is being told that the prosecution is thinking of making someone else an accused. On this, Justice Khanna said that the statement given by the Additional Solicitor General will not come in the way of the decision on Sisodia's bail.
