While responding to questions raised by Congress President Mallikarjun Khadge and Dr. John Bittas in the Parliament, Union Law Minister Kiran Rijuju said that there is no such proposal to reintroduce the National Judicial Appointment Commission (NJAC) with suitable modification.
On Thursday when the question was raised in the parliament Rijuju said that the appointment of the judges of the Constitutional Courts is a continuous, integrated, and collaborative process between the Executive and the Judiciary. He further said that the appointment of judges requires consultation and approval from various authorities both at the state and Central Levels and the Government appoints only those persons as high Court or Supreme Court Judges who are recommended by the Supreme Court Collegium.
Citing details He said that "As on 5th December 2022 there is one proposal for the appointment of a Supreme Court Judge and eight proposals for the appointment of the High Court Judges recommended by the Supreme Court Collegium are pending with the Government. Further, there are 11 proposals for the transfer of High Court Judges, one proposal for the transfer of a Chief Justice and one proposal for the appointment of a high Court recommended by the Supreme Court Collegium are under consideration of the Government."
Rijuju further said that a total of 256 proposals have been remitted by the Government to the High Courts. The proposals are remitted to the concerned High Courts on the advice of the Supreme Court Collegium.
Recently Supreme Court has shown its anguish on the statement made by the Union Law Minister regarding the process of appointment of judges in the constitutional court.
Justices Sanjay Kishan Kaul, Abhay S. Oka and Vikram Nath hearing a petition on 08.12.2022 took serious cognizance of the issue.
