The Bombay High Court has directed Bollywood actor Nawazuddin Siddiqui and his brother Shamsuddin to not upload any social media posts against each other.
The bench of Justice RI Chagla was hearing Nawazuddin Siddiqui's Rs 100 crore defamation suit against his brother Shamsuddin and former wife Zainab alias Aaliya alias Anjana Pandey.
The counsel member of Shamsuddin, Advocates Rumi Mirza and Kaushal Thakkar,submitted that the court there are settlement talks going on between Nawazuddin Siddiqui and his ex-wife due to the intervention of a division bench of the high court and that with the help of this bench, similar measures for settlement could take place between the brothers.
Advocates Abhinav Chandrachud and Sunil Kumar, appearing for the actor, however, pointed out that any talks between the brothers could begin only when Shamsuddin takes down the defamatory posts.
The counsel member further submitted "He has called me a rapist and molester, while there is not a single FIR against the actor. He can't be judge, jury and executioner and tell the whole world. The actor's movies are getting held up due to this public perception."
After taking a note, the bench observed, "I am holding my hands and not seeking any relief against my ex-wife." However, Chandrachud stressed that for any settlement talks the defamatory posts put out by Shamsuddin will have to be taken down.
The court saw that there had been posts as late as March 6 and 7. Mirza, however, protested, saying that the actor had called his brother a "donkey" and alleged that Shamsuddin was the director of a couple of movies which Nawazuddin was now not doing.
However, Justice Chagla said, "For any settlement, the posts casting any aspersions will have to be deleted." When Justice Chagla specified that both brothers would have to stop putting out any defamatory posts, Mirza agreed. But Chandrachud protested, saying that while the actor had said nothing defamatory against his brother, he added that it was Nawazuddin Siddiqui's suit, and the brother cannot get any relief from that.
The bench further asked the lawyers if there would be a mediator required, at which both the lawyers said that they would like to seek the help of the judge’s good office. The bench agreed and asked both the brothers to be present in the chamber of the judge at 4.30 pm on May 3.
