Madras HC rejects VK Sasikala's Appeal, Upholding AIADMK General Secretary Removal

Today, the Madras High Court dismissed VK Sasikala's appeal challenging the decision that upheld her removal as AIADMK General Secretary.

The division bench of Justice R Subramanian and Justice N Senthilkumar rejected Sasikala's appeal to be recognised as the interim General Secretary of the party.

After the passing of former Chief Minister and then General Secretary of the party, J Jayalalitha, in December 2016, Sasikala assumed the interim General Secretary role. Disputes surfaced within the party after her conviction and imprisonment in February 2017 due to a case involving disproportionate assets

In response to these events, a general council meeting convened and made the decision to oust Sasikala from her interim General Secretary position. Instead, the council introduced two new roles—Coordinator and Joint Coordinator—and appointed O Paneerselvam and Edappadi K Palaniswami to these positions, respectively.

Sasikala contested the party's decision by taking the matter to the City Civil Court. Simultaneously, Paneerselvam and Palaniswami filed applications to dismiss Sasikala's complaint, which the court granted.

Sasikala contested her removal by arguing that the general council meeting was conducted without adhering to the party's by-laws. Additionally, she contended that the positions of Coordinator and Joint Coordinator were not outlined in the by-laws, therefore rendering their creation and appointments illegitimate.

Edappadi Palaniswami, representing AIADMK, asserted that Sasikala's expulsion from the party adhered to the proper protocol and due process. He also highlighted that the legitimacy of the General Council meeting had been previously validated by both the High Court and the Supreme Court. Furthermore, Palaniswami emphasized that the Supreme Court had affirmed his appointment as the General Secretary of the party.
