The Madras High Court issued a temporary order on Tuesday, prohibiting the expelled All India Anna Dravida Munnetra Kazhagam (AIADMK) leader O. Panneerselvam (OPS) from asserting himself as the coordinator or an official member of the party. The injunction also prevents him from using the party's official letterhead, symbol, and flag.
Interim injunction was provided by Justice N. Sathish Kumar until November 30 in response to a civil lawsuit brought forth by Edappadi K. Palaniswami (EPS), the present General Secretary of the party and a political opponent of OPS.
In September of this year, EPS approached the Court with a request to prevent OPS from persistently asserting his position as the coordinator and primary member of the AIADMK. Representing EPS, Senior Advocate Vijay Narayan informed the Court that OPS's assertions of being a party member were causing confusion among the general public.
Previously, the Court had given OPS an extension until October 6 to submit a counter affidavit. However, the injunction was issued when OPS failed to file the counter affidavit as ordered.
On Tuesday, Advocate P. Rajalakshmi, representing OPS, requested the Court for additional time. She also informed the Court that OPS had lodged an appeal with the Supreme Court challenging a previous High Court order that declined to intervene in his expulsion from the party. She mentioned that the appeal had been assigned a number and was anticipated to be scheduled for a hearing soon.
Justice Kumar decided to issue the interim injunction because OPS had not obtained favorable rulings in the numerous legal actions related to the leadership of the AIADMK thus far. The Court also noted that if the Supreme Court were to ultimately stay the order, the current injunction would become ineffective.
