Kerala HC Reserves Order on Plea for CBI Probe in Dr. Vandana Das Murder Case

The Kerala High Court has reserved its order on the petition submitted by the parents of Dr. Vandana Das, the 23-year-old house surgeon who was fatally stabbed by an injured man and brought to a government hospital by Pooyappally police. The parents are seeking the transfer of the investigation to the Central Bureau of Investigation (CBI).

Sandeep, a school teacher, inflicted sixteen stab wounds on the young house surgeon using dressing room scissors. Justice Bechu Kurian Thomas listened to the arguments and reserved the order.

Senior Advocate Vijay Bhanu, counsel for the parents, argued that the police, through their actions, demonstrated criminal negligence and breached provisions of the Kerala Police Act by leaving the unarmed victim alone with the accused. 

The Additional Director General of Prosecution, Grashious Kuriakose, contended that the police had diligently concluded the investigation within a span of ninety days. He emphasized that transferring the investigation to the CBI would potentially cause delays in the proceedings.

It was argued that Sandeep was brought to the hospital as an injured person seeking medical treatment, not as an accused. Therefore, there was no anticipation of any untoward incident.

The Additional Director General of Prosecution (ADGP) also informed the Court that a fact-finding inquiry had been initiated by the State Police Chief, considering the concerns raised by Dr. Vandana's parents regarding the police's failure to safeguard their daughter.

Referring to decisions from the Apex Court, the Additional Director General of Prosecution (ADGP) asserted that mere allegations against the state police, lacking cogent reasons, were inadequate grounds for transferring the probe to the CBI. The argument put forth was that a transfer to the CBI should only occur when there is prima facie evidence of bias in the investigation.

The Special Prosecutor for CBI, Senior Counsel Dr. K.P. Satheesan, assisted by Advocates Bharath Mohan and Gokul D Sudakaran, stated that the CBI had no objections and would comply with any order passed by the Court.

The plea has been moved through Senior Advocate P. Vijaya Bhanu and Advocates Sruthy N. Bhat, Nikita J. Mendez, M. Revikrishnan, Ajeesh K. Sasi, Rahul.
