Yesterday, Kerala High Court rejects Pathanapuram MLA KB Ganesh Kumar's plea seeking to quash a case pending against him in connection with alleged conspiracy to falsely name late former chief minister Oommen Chandy in the solar sexual assault case.
The Bench headed by Justice PV Kunhikrishnan, held that, “Serious allegations have been raised against the petitioner [Kumar], who is a member of the Legislative Assembly, by the second respondent. It has been alleged that the petitioner hatched a conspiracy with the first accused to implicate the former chief minister of Kerala Shri Oommen Chandy. The former chief minister has passed away. Such an allegation should not be in the air because his soul will not forgive the same. The continuation of this case is necessary not only for the soul of the former chief minister and his bereaved family, but also to prove the integrity of the petitioner too.”
The court ruled that the case against the MLA, which is currently under consideration at the Judicial First Class Magistrate (JFCM) court - I in Kottarakkara, should continue until a fair and conclusive decision is reached. The court emphasized that if the allegations against the MLA are proven to be unfounded, it would serve to vindicate his integrity.
Ganesh Kumar, a member of the Kerala Congress party, which is a part of the Left Democratic Front (LDF) led by the Communist Party of India (Marxist) in the state, is facing accusations of conspiring to falsely implicate Chandy in a case related to the alleged sexual assault of a woman who is also implicated in the solar scam.
Advocate Sudheer Jacob, a prominent member of the Congress party, who lodged the complaint against Kumar with the Judicial First Class Magistrate (JFCM) court, has asserted that the sexual assault victim presented a letter before the inquiry commission concerning the assault. Jacob alleges that this letter was falsified by Kumar.
