Today, the Kerala High Court instructed the Ernakulam District and Sessions Judge to provide the survivor in the case of sexual assault against Malayalam actor Dileep with a copy of the fact-finding inquiry report. This inquiry pertains to the allegation that the memory card containing videos of the sexual assault was accessed without authorization.
Justice K Babu orally remarked, "This court never intended for the report to be treated as confidential."
The court stated that if the inquiry was concluded within the specified timeframe, a copy of the report should be provided to the survivor. "She has a right to know this," remarked the court. During the hearing of the petition requesting a copy of the report, the survivor's counsel informed the court that the inquiry had been completed by the sessions judge.
Advocate Gaurav Agarwal, representing the survivor, had previously stated that the Memory Card had been accessed three times while in court custody. He explained that on the first occasion, on January 9, 2018, two files were created on the Memory Card while it was in the custody of the Angamali Judicial First Class Magistrate Court. On the second occasion, on December 13, 2018, at 10:58 P.M., three files were created on the Memory Card while it was in the custody of the District Principal Sessions Court, and it was accessed on a device with an Android Operating System. The third instance, according to the Counsel, occurred on July 19, 2021, when 34 new files were created upon being accessed through a Vivo Mobile phone with an Android OS.
In response to these incidents, the Kerala High Court directed the Ernakulam District and Sessions Judge to carry out a fact-finding inquiry into the allegations.
