Kerala HC issues notice to Congress leader KC Venugopal in rape victim's plea

The Kerala High Court has issued a notice to AICC general secretary K C Venugopal following a revision petition filed by the victim in a rape case. This petition challenges a magistrate court's decision to accept the CBI's closure report.

The high court issued the notice during the hearing of the petition submitted by the victim.

In her plea, the victim, who is a prime accused in the solar panel scam, contested the court's acceptance of the CBI's closure report, which cleared the Congress leader of any wrongdoing in the sexual assault case.

She asserted that despite raising an objection by filing a petition, the Chief Judicial Magistrate Court in Thiruvananthapuram accepted the closure report.

The victim stated that in the plea she had submitted to the magistrate court, she had specifically highlighted all the evidence uncovered during the CBI investigation that supports her case and also identified the deficiencies in the investigation.

The woman claimed that the court rejected her petition without providing a single valid and legally sound reason.

In the revision petition submitted to the high court, she stated, "Based on the evidence presented by the CBI in front of the relevant court, it is evident that several witnesses have given statements indicating that both the accused and the victim were present at the Rose House on May 24, 2012, at 4:30 PM."

The Central Bureau of Investigation (CBI) had exonerated all six accused in the case, including Veugopal and former Kerala Chief Minister Oommen Chandy, from the allegations of sexual exploitation made by the woman.

The CBI also presented a separate referral report to the court, absolving BJP leader A P Abdullakutty of the sexual exploitation allegations made by the woman who is the main accused in the high-profile solar scam that shook the southern state during the tenure of the Congress-led government almost a decade ago.

The case against Abdullakutty was filed in 2014 when he was a Member of the Legislative Assembly (MLA) representing the Congress from Kannur. Subsequently, he joined the Bharatiya Janata Party (BJP).

The CBI had also provided referral reports to the court, clearing three other Congress leaders, including Lok Sabha MPs Adoor Prakash and Hibi Eden, as well as MLA A P Anil Kumar, who were accused in the sexual exploitation case filed by the woman.
