Recently, the Kerala High Court granted bail to a man accused of sexually abusing his Minor Daughter.
The father claims that the child made the story up because he objected to her listening to the K-pop band BTS, whose music he considers un-Islamic, and prevented her from going on a school trip.
The matter was heard before the bench of Justice Gopinath P.
Since December 6, a 50-year-old father from Kasaragod has been in judicial custody following allegations of sexually abusing his 14-year-old daughter. As a result, the family court has intervened, directing the daughter to reside with her aunt amid the ongoing legal proceedings.
The individual, whose identity remains undisclosed per the high court's directive, faced allegations of multiple instances of sexual abuse, including inappropriate physical contact with his minor daughter.
The reported incidents occurred both at his residence and in Kochi, during a period when the family was seeing off the man's son, who had departed for London to pursue higher education.
After being denied permission by her father to join a school trip to Wayanad, the girl told her aunt about the alleged assaults she had experienced.
"It is submitted that the allegations have been raised, primarily on account of the fact that the petitioner and his wife objected to the victim following a Korean pop band known as BTS, which according to the petitioner and his wife was un-Islamic," Justice Gopinath P. stated in his order on Wednesday.
The statement contends that the minor victim began following the band due to encouragement from her aunt. Furthermore, it suggests that influenced by the aunt's guidance and upset by the petitioner's refusal to allow her on a school trip to Wayanad (while permitting the petitioner's younger daughter to go), the victim fabricated entirely false accusations against the petitioner.
The court acknowledged the accused's argument that, despite the allegations, his wife and younger daughter chose to remain in the same household and continued to live with him.
