Karnataka HC rejects D K Shivakumar's plea against CBI FIR

On Thursday, the High Court of Karnataka dismissed the plea filed by Deputy Chief Minister and the state Congress chief, D K Shivakumar. His petition had sought to challenge the FIR filed against him by the Central Bureau of Investigation in a case related to disproportionate assets.

The judgment, which had been kept reserved earlier after a hearing by Justice K Natarajan, was delivered on Thursday. Furthermore, the High Court issued a directive to the Central Bureau of Investigation (CBI) to complete the investigation and submit the report within a three-month timeframe.

As of the current status, the CBI has reached the stage where they are preparing to file a charge sheet, having gathered statements from the accused. Although the key details of the judgment rejecting Shivakumar's petition have been provided, the full text of the judgment is still awaited.

The Central Bureau of Investigation (CBI) has put forth allegations claiming that Shivakumar accumulated assets that were disproportionate to his officially documented sources of income during the years spanning from 2013 to 2018. It's important to note that D K Shivakumar served as a minister in the preceding Congress government during this specific time frame.

The Central Bureau of Investigation (CBI) lodged the First Information Report (FIR) against Shivakumar on September 3, 2020. Subsequently, Shivakumar challenged the FIR in the high court in the year 2021.

In 2017, the Income Tax Department carried out a search and seizure operation at both the offices and residence of Shivakumar. Subsequently, this action by the Income Tax Department led to the initiation of a separate investigation by the Enforcement Directorate (ED) into his financial affairs.

Following the investigation conducted by the Enforcement Directorate (ED), the Central Bureau of Investigation (CBI) requested permission from the state government to proceed with filing a First Information Report (FIR) against Shivakumar. The state government granted the necessary sanction on September 25, 2019. Subsequently, the FIR against him was officially filed a year later.

Shivakumar had contested the approval granted by the state government in a separate legal petition, but the high court had previously rejected his challenge to the granted sanction.
