Jharkhand HC Takes Suo Motu Cognizance in MNREGA Scam; Rejects Petition, Initiates Independent Probe

The Jharkhand High Court's division bench, led by Chief Justice Sanjay Kumar Mishra and Justice Anand Sen, delivered its ruling on a PIL concerning the investigation into the alleged involvement of former Deputy Commissioner Pooja Singhal in the Khunti MNREGA scam.

The court decided that it would take up the case independently, disregarding the petition filed by Arun Kumar Dubey due to concerns about his credentials. As a result, the court rejected Dubey's petition, asserting its intention to address the matter on its own accord.

The court converted this petition into suo motu cognizance and directed that it be sent to the competent bench for further hearing. The court will now appoint an amicus curiae in the case and hear the case.

After completing the hearing on this petition on September 15, the High Court reserved its decision.

The applicant, Arun Kumar Dubey, had filed a petition regarding the investigation of the MNREGA scam in Khunti.

The petition states that 16 FIRs have been lodged in Khunti in this case. A surveillance investigation was conducted, but the ACB did not investigate the role of the then Deputy Commissioner, Pooja Singhal.

ED was requested to investigate this. Earlier, the government raised questions about the petition and said that it was not worthy of hearing. The government said that the petition has not been filed as per the rules.

The applicant's credentials have also not been filed. On this basis, the petition should be cancelled. On behalf of the applicant, the court was told that the government's allegations were not justified.

The applicant has given credentials while filing the petition. This petition has been heard several times in the past and the court has also issued several orders on it.
