On Tuesday, the Delhi High Court's division bench of Justice Siddharth Mridul and Justice Talwant Singh in the Jamia Millia Islamia violence case asked the Centre to file a response within a week to the amendment application seeking transfer of investigation in the FIRs registered against the students and on their complaints against police officials from Delhi Police to an independent agency.
Furthermore, the bench adjourned the case seeking an FIR against various political leaders for allegedly making hate speeches during the Northeast Delhi riots until December 19.
Senior Advocate Colin Gonsalves, who represents one of the petitioners, submitted during the resumed hearing before the division bench that the case had previously been substantially heard by another bench. "... and then it was de-part heard. The problem has been going on for about 2.5-3 years. The incident occurred in December 2019. We are eager to begin again, but we must do so at some point "Gonsalves elaborated.
Gonsalves informed the court that an amendment application for specific prayers had also been filed. The application has not yet been approved, according to Advocate Rajat Nair, who represents the police. The court stated that it must first determine the scope of the proceedings.
When the court was informed that no response to the application had been filed despite the issuance of notice, it stated, "so we will give you [Centre] until next week to file a reply to this application."
The application, to which the Centre has been asked to respond, also requests the formation of an independent SIT led by any of the four officers on a panel of four: Vibhuti Narain Rai, Vikram Chand Goyel, RMS Brar, and Kamlendra Prasad.
