On January 16, a Supreme Court division bench led by Chief Justice of India DY Chandrachud expressed surprise that the State of Madhya Pradesh intended to challenge the anticipatory bail granted to a law college principal in relation to a FIR registered over an alleged "Hinduphobic" book discovered in the library. The Court was hearing a petition filed by Dr Inamur Rahman, the now-resigned principal of Indore's Government New Law College, seeking protection from arrest in the case. The Court granted him interim protection from arrest on December 16, 2022, after the Madhya Pradesh High Court denied him interim anticipatory bail in the case.
When the case was heard on Monday, the petitioner's counsel, Advocate Aljo K Joseph, informed the bench that he had been granted anticipatory bail by the Madhya Pradesh High Court for December 22, 2022. The State's position surprised the bench. "State must do some more serious stuff. He is a College Principal. Why you are arresting him? A book is found in the library which is said to have some communal undertones. Therefore he is sought to be arrested. The book was purchased in 2014. And he is sought to be arrested? Are you serious?", CJI Chandrachud inquired of the State's counsel.
According to the State's counsel, students have complained that the petitioner has been teaching from the book, contradicting his defence that he was unaware of its existence.
According to the petitioner, the book in question was published in 2014 and purchased by the college in the same year. According to the petitioner, he was a professor at the college at the time and not the Principal.
He claimed that the case was filed for political reasons and that the petitioner, who was not involved in the book's publication or marketing, was unnecessarily dragged into it. It also states that the book was purchased prior to the petitioner's tenure, in 2014, when he was merely a professor and not involved in the process of purchasing books for the college library.
Following ABVP protests, the petitioner resigned as Principal.
