Fugitive liquor baron Vijay Mallya’s property to be confiscated, Supreme Court rejects challenge

India’s fugitive liquor baron Vijay Mallya got a blow from the Supreme Court. A petition was filed on behalf of Mallya before Supreme Court challenging the order of a Mumbai court, by which his property was ordered to be confiscated. The Supreme Court rejected the petition of Vijay Mallya. Together with this, the property might be confiscated while declaring the fugitive businessman as a financial offender.

The Supreme Court on Friday dismissed a petition by fugitive businessman Vijay Mallya. The petition was filed challenging the continuing proceedings in a Mumbai court to declare him a financial offender and confiscate his property. The Supreme Court has dismissed the plea of Vijay Mallya’s lawyer to not prosecute after he argued that he was not getting any directions from the petitioner within the matter. The counsel for the petitioner had stated that he was not giving any instruction to him on this matter. A bench of Justice Abhay S. Oka and Justice Rajesh Bindal stated that in view of this assertion, the petition for not prosecuting is dismissed.

The Supreme Court had on 07th December 2018 issued orders to the Enforcement Directorate (ED) on Mallya’s plea and refused to remain the probe company’s plea earlier than a particular Prevention of Money Laundering Act (PMLA). A court in Mumbai declared Vijay Mallya a fugitive on 5 January 2019 the PMLA Act. Vijay Mallya left the nation in March 2016.

As per the provisions of the Act, as soon as an individual is asserted as a fugitive and financial offender, the prosecuting agency has power to confiscate his property. Vijay Mallya fled to Britain in March 2016.
