The Supreme Court on Friday asked Andhra Pradesh Police not to arrest TDP chief N Chandrababu Naidu in the Fibernet case till the decision on his plea in the skills development scam case is taken.
A bench of Justices Aniruddha Bose and Bela M Trivedi listed Naidu's anticipatory bail in the Fibernet case for hearing on November 9. The top court told Andhra Pradesh Police to let the earlier arrangement remain intact.
The bench was referring to the statement of Andhra Pradesh Police on October 13, when it had said that the police would not take Naidu into custody.
Justice Bose said that since the order has been reserved on another petition, it would be appropriate that the court consider Naidu's urgent petition after the judgment is pronounced.
Senior advocate Siddharth Luthra, appearing for Naidu, said the police were seeking to take him into custody in the Fibernet case, despite the fact that he is already in custody in the skill development scam case. Senior advocate Ranjit Kumar, appearing for the Andhra Pradesh government, said it would seek permission from the court for custodial interrogation of Naidu in the Fibernet case as he is already in judicial custody in another case.
He said that the state has no problem in waiting for the court's decision. The bench said, 'Let the arrangement given earlier remain intact.' On October 13, Andhra Pradesh Police told the apex court that they would not arrest Naidu in the Fibernet case till October 18 as his petition related to the Skill Development Corporation scam was pending in the apex court.
The Fibernet case pertains to alleged tender manipulation in allotting work orders worth Rs 330 crore to a preferred company under Phase-1 of the AP Fibernet project. The Criminal Investigation Department (CID) of Andhra Pradesh Police has alleged that there were irregularities in the project from the award of tender till the completion of the work, causing huge loss to the state exchequer.
Naidu, 3, was arrested on September 9 for allegedly misusing funds from the Skill Development Corporation when he was chief minister in 2015, causing an alleged loss of Rs 371 crore to the state exchequer. He is in judicial custody in Rajamahendravaram Central Jail.
