On October 11, 2022, the Election Commission of India approved the plea of the former Chief Minister of Maharashtra regarding allowing the name Shiv Sena (Uddhav Balasaheb Thackrey) and the symbol of a "flaming torch" to his party group.
Earlier, on October 8th, the Election Commission of India rejected both Uddhav and Eknath Shinde's groups from using the name "Shiv Sena" and Symbol "Bow and Arrow" as official names and symbols due to persistent disputes between them. Unsatisfied with the order, Uddhav Thackrey has filed a Petition challenging the decision before the Delhi High Court, as well as filed a new application for party name and symbol allotment.
Among the choices for symbols, the former Chief Minister of Maharashtra's first preference was "Trishul", which was instantly declined by ECI, stating that the symbol has religious relevance, which is violative of Section 10 (B)(A)(iv) of the Election Symbols (Reservation and Allotment) Order, 1968, as well as this symbol, was proposed by Shinde’s group as their first preference.
The second preference of Uddhav Thackrey, which was "Rising Sun," was also rejected because the symbol is already used by Dravida Munnetra Kazhagam, a recognized political party in the state of Tamil Nadu and Union Territory of Puducherry. This symbol is also proposed by Shinde’s group as their second preference.
Finally, the ECI gave their consent for use of the symbol "flaming torch" despite it not being on the list of free symbols and being already used by the party, which was unrecognised in 2004.
In his plea to the Delhi High Court, Uddhav Thackrey challenged the order of the ECI to freeze Shiv Sena's official name and the Arrow as a Party Symbol.
