Delhi High Court Finds Sameet Thakkar Guilty of Contempt, Fined ₹1 Lakh for Defamatory Tweets Against TV Today Network

The Delhi High Court found Sameet Thakkar in contempt and fined him ₹1 lakh for disregarding a directive not to post defamatory tweets about TV Today Network.

The bench headed by Justice Rekha Palli noted Thakkar's complete defiance of the court's orders, suggesting that a strong response was necessary in dealing with his actions. The Court highlighted its inability to accept Thakkar's apology, emphasizing its lack of explanation for his actions in posting the tweets despite clear orders prohibiting him from doing so.

In May 2020, the High Court issued orders prohibiting Thakkar from publishing any derogatory or defamatory tweets directed at TV Today, the media company behind news channels such as Aaj Tak and India Today.

Following a lawsuit filed by TV Today due to Thakkar's publication of numerous tweets containing derogatory or defamatory language against the channel, its management, employees, and anchors, TV Today filed an application asserting that Thakkar was disobeying the court's orders.

Advocate Raghav Awasthi, representing Thakkar, stated that his client was prepared to offer an unconditional apology. Additionally, he confirmed that the tweets in question had already been removed.

Despite Thakkar's apology and the removal of the tweets, the Court still found him guilty of contempt. TV Today's counsel pushed for civil imprisonment as a penalty, but Justice Palli deemed that justice would be served by imposing a fitting fine instead.

The Court also directed that the amount be paid to the Delhi High Court Bar Clerk's Association.

The Court scheduled the next hearing for April 1, 2024, to further address the case.

Thakkar was accused of having committed offences under Sections 500, 501 (defamation), 504 and 505 (provoking breach of peace) of the Indian Penal Code (IPC).
