Delhi HC Sends Notice to Central Government Over AAP's Request for Land to Build Party Offices

On Tuesday, the Delhi High Court directed the Central government's attention to a plea submitted by the Aam Aadmi Party (AAP). The plea requested appropriate land within the national capital for the construction of both its National and Delhi state unit party offices.

AAP approached the Court seeking specific directives from the Central government to secure land ideally situated in central areas of New Delhi, devoid of any hindrances or unauthorized occupations. This initiative aimed to facilitate the prompt commencement of construction for the party's office.

Under the supervision of Justice Subramonium Prasad, the case was heard, and directives were issued to both the Central government and the Land and Development officer from the Ministry of Housing and Urban Affairs. They were given a six-week timeframe to respond to the petition filed in the matter.

AAP presented the argument that, due to its status as a national party, it holds the entitlement to acquire a total area measuring 1,000 square meters for the construction of its offices, encompassing both the national and state units.

"The Memorandum dated 13.07.2006 explicitly outlines the allocation of land, specifying up to 500 square meters for all National parties with up to 15 Members of Parliament in both Houses. Moreover, it stipulates an additional provision allowing for an allocation of up to 500 square meters specifically for Delhi state units, provided the National Party holds representation in the Delhi State legislature," as stated in the plea.

The contention put forth was that, given the Central government's prior allocation of land to various political parties for constructing office premises, there exists an obligation to ensure a parallel allocation in favor of AAP as well.

AAP's argument rested on the assertion that the government's denial of land allocation to Delhi's ruling party, even six months following its recognition as a National Party, was deemed both arbitrary and discriminatory. This was emphasized as a pivotal concern during their presentation.

The matter will now be heard on April 23, 2024.
