Delhi HC requests trial record in Geetika Sharma's mother's suicide case

The Delhi High Court has requested the trial court's records in the case involving the abetment to suicide of Geetika Sharma's mother, who passed away six months after her daughter. This request was made in response to a plea by the State challenging the decision to revoke the summons issued to former Haryana Minister Gopal Kanda.

Justice Swarana Kanta Sharma has ordered that the trial court records for this case should be obtained in a digital format by October 31.

The State's appeal, contesting the trial court's decision from October 26, 2020, which nullified the summoning of Gopal Kanda and his associate Aruna Chadha, is scheduled for a hearing on October 31 as well.

The high court's decision was a response to a request submitted by the State through additional public prosecutor Amit Sahni. The plea emphasized the importance of having access to the trial court records for the proper resolution of this case.

In October 2020, an additional sessions judge had overturned the decision of a magisterial court that had issued summons to Gopal Kanda and Aruna Chadha as the accused in the case.

Initially, the Delhi Police had submitted a closure report in the case, but it was not accepted by the magisterial court. The magistrate concluded that a case could be established against the two individuals and proceeded to take cognizance of the matter under IPC sections 306 (abetment of suicide) and 34 (common intention), subsequently issuing summons to both of them.

In February 2013, Anuradha Sharma was discovered hanging from a ceiling fan in her residence in Ashok Vihar. In a suicide note left behind, the 52-year-old government employee had alleged that Gopal Kanda and Aruna Chadha had compelled her and her daughter to resort to this extreme measure.

On July 25, 2023, a Delhi court acquitted Gopal Kanda and Aruna Chadha in the Geetika Sharma suicide case. The court stated that the possibility of the deceased taking her own life for reasons other than those attributed to the accused could not be dismissed. Additionally, the court pointed out that the prosecution had not succeeded in establishing the charges against the two individuals beyond a reasonable doubt.

Geetika Sharma, who had previously worked for Kanda's MLDR Airlines, was discovered deceased on August 5, 2012, at her residence in Ashok Vihar, located in north-west Delhi.

In her suicide note dated August 4, 2012, Geetika Sharma had expressed her intention to end her life, citing "harassment" by Gopal Kanda and Aruna Chadha as the reason for her decision.

Gopal Kanda was compelled to resign from his position as the Minister of State for Home after the case was registered against him.
