The Delhi High Court has issued an order preventing three nearby dhabas from using the trademarked logos or names associated with the well-known Murthal eatery, "Mannat Dhaba.''
The bench headed by Justice Anish Dayal issued an ex-parte ad-interim injunction against three defendants who were operating their restaurants under the names Mannat Dhaba, Shri Mannat Dhaba, and Apna Mannat Dhaba.
The recent events unfolded within a legal case initiated by the Mannat Group of Hotels aiming to safeguard their registered trademarks, including Mannat, Mannat Dhaba, Mannat Group, Mannat Resorts, etc., against any unauthorized usage or infringement.
According to the Local Commissioner's report, the defendant eatery named Mannat Dhaba lacked valid reasons for adopting and utilizing the trademark and logo "MANNAT" belonging to Mannat Group. Additionally, the owner showed complete non-cooperation in this matter.
The other defendant, Shri Mannat Dhaba, was initially recognized as "DELIGHT AMBROSIA." However, it underwent a rebranding in May-June of the previous year, seemingly to compete with newly established highway restaurants bearing similar branding in the nearby area.
The owner of Defendant Apna Mannat Dhaba informed the Local Commissioner that they had assumed control of the restaurant approximately 2-3 months prior and decided to maintain the "Mannat" branding due to its prevalent use by other dhabas in the nearby area.
Justice Singh emphasized that considering the defendants' efforts to rebrand their restaurants, they are free to reach out to Mannat Group's legal representatives to potentially resolve the matter. This could involve options such as rebranding their dhabas or exploring other suitable methods to address the issue amicably.
