Delhi HC Injunctions Rajat Srivastava from Hosting 'Ratan Tata Icon Award' Over IPR Violations

The Delhi High Court on Friday issued an injunction against Rajat Srivastava, prohibiting him from hosting the 'Ratan Tata Icon Award' following a lawsuit filed by the Sir Ratan Tata Trust and Tata Trusts for intellectual property violations.

The Court also restrained Srivastava from using the logo, images, or any representation of Ratan Tata and the Tata Trusts.

During the hearing, the Court raised the question of whether 'Ratan Tata' could be recognized as a well-known trademark due to his significant public recognition.

Justice Mini Pushkarna remarked, "This Court notes that Tata is a well-known mark. Late Mr. Ratan Tata is a well-known figure. His name itself is liable to be protected."

The defendant, Rajat Srivastava, agreed to discontinue the use of Ratan Tata's name and cancel the awards, leading to the suit being decreed. However, the Court has requested an undertaking from the defendants, and the case will be revisited on February 12 for compliance.

The case centers around the unauthorized use of prominent trademarks, logos, and the personal name of Ratan Tata, which are closely associated with the Tata Group. The Sir Ratan Tata Trust and Tata Sons initiated the lawsuit to safeguard their intellectual property, reputation, and the goodwill they have developed over the years.

Srivastava, along with his company Yuci Mentors Private Limited, stands accused of organizing fraudulent events and awards, such as the "Ratan Tata National Icon Award," while falsely claiming affiliations with the Tata Trusts and Ratan Tata, thereby misleading the public and damaging the plaintiffs' reputation.

Despite a takedown notice issued to the defendants in December 2024, Srivastava continued promoting these events on social media and his website, exacerbating the infringement. The plaintiffs have sought permanent injunctions to prevent further misuse of their trademarks, logos, and Ratan Tata's image, along with damages amounting to ₹2 crore for the harm caused to their reputation.

Senior Advocate Rajeev Nayar, along with Advocates Pravin Anand and Achuthan Sreekumar from Anand & Anand, represented the plaintiffs.
