Delhi HC Halts 44 Rogue Websites' Streaming of Content from Six American Studios

The Delhi High Court has issued a 'dynamic+ injunction' order in support of six American studios. This order prohibits 45 unauthorized websites, along with their mirror/redirects or alphanumeric variations, from streaming or making available for download any current or future content belonging to these studios.

Justice Prathiba M Singh issued the order following a lawsuit filed by Netflix Studios, Disney Enterprises, Warner Bros, Columbia Pictures, Paramount Pictures, and Universal City Studios.

“Accordingly, Defendant Nos. 1 to 45 arrayed as Annexure A, which are all rogue websites shall stand restrained from streaming, reproducing, distributing, making available to the public and/or communicating to the public, in any manner, any copyrighted content of the Plaintiffs including future works of the Plaintiffs,” the Court ordered.

The court directed Internet Service Providers (ISPs), the Department of Telecommunications, and the Ministry of Electronics and Information Technology (MeitY) to block access to these websites.

"The Domain Name Registrars (DNRs) of the rogue websites' domain names are instructed to lock and suspend these domain names upon receiving notification from the Plaintiffs. Moreover, any information regarding the registrants of these domain names, such as KYC, credit card details, mobile numbers, etc., should also be disclosed to the Plaintiffs," the Court stated.

Interestingly, the Court had previously issued a similar dynamic+ injunction order in August, restraining 16 rogue websites from publishing copyrighted works of these studios. In their recent lawsuit, the studios informed the Court that post the August order, numerous rogue websites were being blocked globally, not just within India's borders. This global action had a significant impact in curbing internet piracy. They highlighted the effectiveness of these orders by citing an example: the 2023 Cricket World Cup finals witnessed over 5.3 crore logins, indicating a marked decrease in piracy.

Advocates Saikrishna Rajagopal, Suhasini Raina, R Ramya, Mehr Sidhu and Raghav Goyal appeared for the plaintiff studios.

None appeared for the defendants.
