Delhi HC Grants Interim Order Against One8 Commune: Restrains Use of PPL-Copyrighted Music

The Delhi High Court has just taken a step by issuing a temporary order that prohibits the restaurant/café chain One8 Commune, which is owned by Virat Kohli, from playing songs that are copyrighted by Phonographic Performance Limited (PPL).

Justice C. Hari Shankar's bench ruled that the order stands until the next hearing, underscoring that One8 Commune must refrain from playing PPL's songs unless they secure the required license.

PPL, the Phonographic Performance Limited, filed a copyright infringement lawsuit against One8 Commune to halt the use of PPL's songs in the chain's eateries. PPL claimed that One8 Commune played their songs without the necessary copyright license, even after being served a legal notice regarding the issue. Nonetheless, One8 Commune did not adhere to the conditions specified in the legal notice.

The legal representatives of One8 Commune offered an assurance to the court, promising that the chain would abstain from playing PPL's copyrighted music unless they secured the requisite license.

Justice Hari Shankar acknowledged this commitment, emphasizing that, on the surface, the legal stance was evident. As PPL holds the copyright to the recordings, the court held that playing these recordings without a license is prohibited for any other entity.

Subsequently, the court proceeded to issue the interim order, highlighting the significance of adhering to regulations concerning copyright licensing.
