Delhi HC Directs Center to Expedite Decision on AAP's Temporary Office Space in State

The Delhi High Court has mandated the Central government to promptly decide on providing temporary office space for the Aam Aadmi Party (AAP) in the national capital to facilitate its operational activities. Justice Subramonium Prasad emphasized the need for a swift resolution, setting a six-week deadline for the decision.

The AAP's contention rests on the principle of equitable allocation, citing previous allotments to other political parties for office construction. The court underscored that the AAP, as a recognized political entity, deserves accommodation from the 'General Pool' category, dismissing mere unavailability as a valid reason for denial.

"Mere pressure or non-availability is no ground to reject [their plea]. Pressure is always there. Their representation to be considered in 6 weeks by a reasoned order," the Court said.

This directive follows the Supreme Court's instruction in March for AAP to vacate its current office near Rouse Avenue by June 15, as the land was earmarked for judicial infrastructure expansion. In response, AAP had petitioned the High Court twice, seeking suitable land for constructing its national and Delhi state unit offices or temporary housing arrangements.

“The Memorandum dated 13.07.2006 clearly prescribes allotment of land up to 500 square meters to all National parties having up to 15 Members of Parliament in both Houses. Further, it also provides for an additional allocation of land up to 500 square meters for Delhi state units where the National Party has representation in the Delhi State legislature,” the plea said.

While today's ruling addresses the plea for temporary accommodation, a hearing for permanent arrangements is scheduled for July 10. AAP asserts its entitlement to a total area of 1,000 square meters for constructing offices for both its national and state units, citing its national party status.
