Delhi Court directs 1000 Rupees Compensation, Sets Next Hearing for Gyanvapi Premises Survey Application as Lawyer Falls Ill

On Friday, the court levied a fine of one thousand rupees in response to the application requesting a survey of the entire Gyanvapi premises. Additionally, the court scheduled the next hearing for the 21st, citing the lawyer's illness as the reason for the adjournment.

On Friday, a hearing took place in the courtroom of Civil Judge (Senior Division Fast Track) Prashant Kumar Singh regarding the application submitted by lawyer Vijay Shankar Rastogi in the 1991 case initiated by self-styled Vishveshwar Jyotirling. The application sought a comprehensive survey of the entire Gyanvapi premises.

Objections were raised by Anjuman Intejamia Masjid and Sunni Central Waqf Board. Simultaneously, the sons of plaintiff party number four (late Harihar Pandey), Pranay Kumar Pandey and Karan Shankar Pandey, requested a rescheduling of the hearing. They cited the ill health of their lawyer, Harishankar Jain, who was unable to attend from Delhi.

Vijay Shankar Rastogi opposed the demand for adjournment of the hearing. He said that the High Court has ordered to dispose of the case within six months. The hearing will be unnecessarily affected by such an adjournment application. The court accepted the appeal of Pranay and Karna, but also imposed a compensation of Rs 1000 on both of them.

On behalf of Shailendra Pathak, grandson of Pt. Somnath Vyas, an application has also been given to make him a party in this case. His lawyer Sudhir Tripathi raised this issue during the hearing.

On October 15, 1991, Late Harihar Nath Pandey and Rasrang Sharma, representing self-styled Vishveshwar Jyotirling alongside Pt. Somnath Vyas, filed an appeal in the courtroom of Civil Judge (Senior Division). The appeal pertained to the construction of a new temple in Gyanvapi and granting Hindus the right to worship. Subsequently, I initiated a case in response to this appeal.

Pt. Somnath Vyas died on March 7, 2000. To plead in his place, the court appointed former district government advocate (civil) Vijay Shankar Rastogi as amicus curiae. Harihar Nath Pandey also died on 10 December 2023. On January 19, 2024, both his sons had applied to become parties in the case in place of their father.

Despite tight security measures, individuals offered Namaz at Gyanvapi and various other locations on Friday. The Additional Commissioner of Police and Law and Order is personally overseeing security operations with a substantial deployment of forces. Additionally, ACP Atul Anjan Tripathi was observed patrolling the Bajardiha area alongside the Bhelupur police.
