CREDAI Withdraws PIL from Allahabad HC Seeking Improved Public Access

Recently, the Confederation of Real Estate Developers of India (CREDAI) withdrew its public interest litigation from the Allahabad High Court. The litigation sought directions to the New Okhla Industrial Development Authority and Greater Noida Industrial Development Authority to ensure safe access for the public to their offices and to designate a specific area for protesting farmers, subject to permission from the competent authority.

The PIL stated that farmers have been regularly protesting and staging dharnas outside the offices of the New Okhla Industrial Development Authority (NOIDA) and Greater Noida Industrial Development Authority (GNIDA). Their demands include additional compensation, job reservations, and the allotment of abadi land in exchange for the land acquired by the authorities.

The petitioner claimed that due to these protests, the development authorities close their gates, preventing the public from entering their premises and causing significant hardship.

CREDAI, representing developers working on land acquired by NOIDA and GNIDA, raised concerns about developers being denied access to the authorities' offices, which hampers projects. The plea argued that the unauthorized protests were causing significant public loss by stalling development projects.

Accordingly, the petitioner approached the High Court seeking directions for NOIDA and GNIDA to allocate a separate area for farmers to protest and to allow the general public, including developers, to enter their offices so that development work could proceed without hindrance. The petitioner also sought a writ of mandamus against the State, requesting adequate security measures in and around the offices of the development authorities.

The matter was heard by the bench of Chief Justice Arun Bhansali and Justice Vikas Budhwar who dismissed the petition as withdrawn. Petitioner was directed to pursue remedy in accordance with law.
