The Supreme Court Collegium headed by CJI DY Chandrachud has recommended Andhra Pradesh High Court Chief Justice Prashant Kumar Mishra as a judge of the Supreme Court. Supreme Court resolved the same in its meeting held on 15th May 2023 and the resolution to this effect has been uploaded on the Supreme Court's website on 16th May 2023.
As per the resolution by the Collegium led by Chief Justice of India, the decision was made after careful evaluation of the merit, integrity, and competence of eligible Chief Justices and senior puisne Judges of the High Courts, as well as accommodating a plurality of considerations.
Justice Mishra was elevated as the Chief Justice of the Andhra Pradesh High Court on 13th October 2021.
He has also been Acting Chief Justice of Chhattisgarh High Court and has also served as Judge of the Chhattisgarh High Court.
The resolution also says that there was no representation to the High Court of Chhattisgarh in the present composition of the Supreme Court.
It further says "Besides according representation to the State of Chhattisgarh, the appointment of Justice Prashant Kumar Mishra will provide a value addition in terms of his acquired knowledge and experience. Justice Mishra is a judge with integrity".
The Collegium also addressed the fact that Chief Justice Pritinker Diwaker of the Allahabad High Court was drawn from Chhattisgarh High Court and ranked senior to Justice Mishra.
However, having considered all relevant factors, it was of the view that Justice Mishra is worthy of elevation to the Supreme Court.
