Bombay High Court passed the stay order on an appeal filed by GoDaddy against Swiggy

MUMBAI: Yesterday on 28th February 2023, in the matter of GoDaddy.com LLC v. Bundl Technologies Private Limited, the Division bench of the Bombay High Court granted Interim relief to GoDaddy. The previous order was passed by a single judge in which the court directed GoDaddy to inform Swiggy whenever a domain name containing the mark 'Swiggy' is registered.

The bench was headed by Justices KR Shriram and Rajesh Patil. During the previous hearing which was held on 23rd January, GoDaddy filed an appeal. After that, Swiggy moved to the Bombay High Court and filed an infringement suit complaining that using domain names was deceptively similar to its mark.

Earlier in November 2022 Bombay High Court passed an order in which the Court directed GoDaddy to suspend registrations of domain names containing the mark 'Swiggy' during the pendency of a suit filed by Swiggy.

 Further, in January, the Court directed to instead inform Swiggy about any infringement so that appropriate action can be taken.

During the hearing Justice Pitale had passed the order keeping in mind Swiggy's interest and in light of a 'peculiar situation' wherein entities posing as associates of Swiggy were duping people of money under the promise of bringing them on board the 'Swiggy Instamart' platform.

After the Court orders, GoDaddy moved the present plea against the order of single-judge.
