Bombay HC Temporarily suspended Travel Restrictions for Rhea Chakraborty, Allows Dubai Trip Amidst CBI Investigation

Bollywood actressThe Central Bureau of Investigation (CBI) was conducting an investigation involving the actress in connection with the Sushant Singh Rajput Death case.
Rhea Chakraborty received temporary relief from the Bombay High Court as they suspended the Look Out Circular (LoC) issued by the Central Bureau of Investigation (CBI). The court has granted her approval to travel to Dubai for a week.

During the vacation session, Justices Kamal Khata and Jitendra Jain presided over the high court bench that considered the actress's request. She sought approval to travel to Dubai for an event promoting Drools Pvt Ltd, a pet food company.

On December 20, the CBI contested Chakraborty's plea, asserting that she was no longer affiliated with the company as its brand ambassador. Additionally, the agency highlighted that they were in the process of verifying her assertions. The CBI emphasized that the FIR originated in Patna and was under investigation by the Delhi CBI team, indicating that the Bombay High Court lacked jurisdiction to offer relief to Chakraborty.

Advocate Abhinav Chandrachud, speaking on behalf of Chakraborty, notified the bench about her travel plans, aiming to be in Dubai from December 27, 2023, to January 2, 2024. Chandrachud reiterated that Chakraborty retained her status as the brand ambassador of the company. Advocate Shreeram Sirsat informed the bench that the contractual agreement between the company and Rhea pertained exclusively to activities within Mumbai. Nonetheless, the bench highlighted that she had already received payment for engagements encompassing both the Mumbai and Dubai events.

The bench inquired with Sirsat about the potential compensation from the CBI in case Rhea couldn't travel overseas to fulfill her contractual commitments. Furthermore, during the hearing, the bench underscored to the CBI that Rhea's profession was that of an actor, not an industrialist. This emphasized the necessity for her to return to India to sustain her livelihood.

The division bench of the high court probed the CBI about the rationale behind opposing the application, particularly noting that the actress hadn't been required for any investigation in the past six months.

The CBI's counsel responded by indicating the formation of a new Special Investigation Team (SIT). However, the bench clarified that this team was assembled for other associated cases, not specifically pertaining to the actress in question.
