Bombay HC reprimanded Maharashtra govt for stopping pension, said- this is a basic right, cannot be stopped

Bombay High Court described pension as a fundamental right for retired employees. The Bombay High Court said that pension is a fundamental right and retired employees cannot be deprived of its payment.

The Bombay High Court rapped the Maharashtra government for not clearing a person's dues for more than two years after his retirement. A division bench of Justice GS Kulkarni and Justice Jitendra Jain said on November 21 that such a situation is completely unfair.

The Bombay High Court was hearing the petition filed by Jairam More. According to the petition, Jairam More worked as a Hamal (porter) at Savitribai Phule Pune University since 1983. More claimed in his petition that the pension was not being paid despite the university submitting all the necessary documents to the concerned department of the state government.

Hearing this petition, the bench said that More has rendered commendable and impeccable service, but still he has not been paid pension even after a period of two years of retirement in May 2021. The bench said, 'Right from the beginning of the present proceedings, we were wondering whether a person who has served for such a long period can be subjected to such a plight.'

The bench said that the retired employee should not be deprived of his basic right to pension. He cited a four decade old order of the Supreme Court. He said pension is a fundamental right and its payment does not depend on the discretion of the government and will be governed by rules.

The bench said that a large number of cases are coming to this court in which people are demanding payment of their pension amount. It seems that the Supreme Court order has been forgotten instead of being implemented in true spirit.

The high court, in its earlier order, had said that More had to suffer for three years and directed the government to take all necessary steps to release the pension benefits within four weeks. However, the government told the bench that More's outstanding pension has been released and he has also received it.
