On Wednesday, the Bombay High Court accepted an appeal submitted by artist Chintan Upadhyay for a final hearing. This appeal concerns his conviction for his role in conspiring to commit the murder of his estranged wife, Hema Upadhyay, and her lawyer, Haresh Bhambhani, in December 2015.
A panel of judges, including Justices Revati Mohite-Dere and Gauri Godse, also announced their intention to consider Chintan Upadhyay's application for bail and the suspension of his life sentence in two weeks.
Members of Haresh Bhambhani's family have also submitted an application objecting to Chintan Upadhyay's appeal and his request for bail.
In a recent development, a sessions court in the area had convicted Chintan Upadhyay and three other individuals earlier this month. The court acknowledged the brutality of the double murder but did not consider it to be a "rarest of rare" offense that would merit the death penalty.
Chintan Upadhyay, in his appeal, asserted that the trial court's judgment was deficient in terms of providing adequate and coherent evidence and reasoning.
