Bar Associations Election in Rajasthan: High Court clears the way; BCI's Appeal dismissed

A Division Bench of Justice MM Srivastav and Justice VK Bharwani cleared the way to conduct elections in the Bar Associations across Rajasthan by dismissing a Special Appeal filed by the Bar Council of India against the interim order of the Single Bench of Rajasthan High Court. Earlier the Single Bench comprising Justice Mahendar Goyal had stayed the Bar Council of India's interim order dated 03.10.2022 which had stayed the election across Bar Associations in Rajasthan by the order dated 11.10.2022.

The order of the Division Bench was passed in view of the order of the Supreme Court.

The election process in the High Court Bar Association is underway and the voting is scheduled for 16.12.2022. Now the deck is cleared by the Division Bench of the Rajasthan High Court to complete the election process.

The Writ Petition was filed by advocates contesting for the post of President- Prahlad Sharma and Rohan Jain, for the post of Vice-President Sharvan Saini and the candidates contesting for the post of General Secretary of Rajasthan High Court Bar Association Sushil Pujari, Sanjay Khedar, Jagmeet Singh, Balram Vashisht, Dharmendra jain, Jaideep Singh and Rohit Sharma.

Advocate Sumer Singh Ola of the Rajasthan High Court had approached the Bar Council of India to stop the election in High Court Bar Association, Jaipur on the ground that the guidelines issued by the Supreme Court to conduct Bar Association Election are not being followed.
