Allahabad HC warns against arbitrary use of bulldozer, stresses emotional value of homes to PDA

In a recent legal case centered on the demolition of a lawyer's residence in Jhansi, the Allahabad High Court issued critical remarks, underscoring that the use of bulldozers should not be arbitrary. The court noted that while it takes years to construct a home, it only takes moments to tear it down. This drew attention to the demolition action and prompted the court to demand an explanation from the Chairman of the Prayagraj Development Authority (PDA) regarding ongoing development projects and future plans, with a deadline set for November 20.

During the hearing, the PDA's regional officer, Sanjeev Upadhyay, found himself in an awkward position when he admitted that he was unaware of the High Court hearing scheduled for the day after the lawyer's house was demolished on November 2. The court remarked that no one should bring a bulldozer to someone's property without being informed about ongoing court proceedings, even if the individual involved is a lawyer.

Tensions rose when the Bar Association President presented an audio-video recording on a CD as evidence, alleging harassment of the public during construction by the authorities. When asked to respond, the PDA officials remained silent, prompting the court to suggest playing the recording right there in the courtroom.

The court questioned the legal officer of the PDA regarding the issuance of demolition notices and whether they acted independently or in accordance with higher directives. The officer stated that notices were issued in accordance with established rules. However, the Bar Association President claimed widespread corruption within the PDA's notice-issuing process, leading the court to order the immediate presentation of all notices held by the PDA.

PDA officials informed the court that they had demolished 50 illegal constructions in the city and issued notices to 300 individuals in the Jhansi zone, which had caused public unrest. The court scheduled further hearings on November 20 to address these issues.
